1. Acceptance of Terms

By registering an account or using any aspect of the KanoonHQ platform (including our API, web app, and mobile app), you agree to be bound by these Terms of Service, our Privacy Policy, and any other agreements referenced herein. If you do not agree to these terms, you are prohibited from accessing or using our services.

2. Nature of Service & AI Co-Counsel Limits

The KanoonHQ platform provides:

• Semantic retrieval and full-text searches of Indian Central and State Acts, BNS concordance, and historical court judgments.
• AI-powered explanation of case orders, hearing preparation reporting, and document drafting templates.
• Automated eCourts case status scraping and WhatsApp alerts based on publicly available digital court data.

You acknowledge that AI models (including those processing document analysis and drafts) are probabilistic and may occasionally generate inaccurate or incomplete summaries, hallucinate case details, or omit relevant provisions. **You are solely responsible for reviewing, verifying, and validating all output generated by the platform before using it in any pleading, court submission, or legal consultation.**

3. Account Registration & Phone Verification

To access the workspace, you must authenticate using a digital phone number and verify it via a secure One-Time Password (OTP). You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your authentication tokens and OTPs confidential and secure.
• Notify us immediately of any unauthorized use or security breach of your account.
• Declare that you are at least 18 years of age (the legal age of majority in India).

4. Acceptable Use & AI Safety Guardrails

You agree not to misuse our platform or attempt to bypass any built-in rate limits or security controls. In particular, you shall not:

• Attempt to scrape our proprietary semantic database or judgment corpus at scale.
• Submit files containing malware, trojans, or executable scripts disguised as PDFs or images.
• Engage in prompt injection, jailbreaking, or attempting to coerce the legal RAG engine to produce non-legal output.
• Bypass our API rate limits or credit system through automated bots, script clusters, or parallel calls.

5. Subscriptions, Payments & Credit Policy

We offer paid subscription tiers (Pro and Pro+) and add-on credit packages processed securely through Razorpay.

• Billing Cycle: Subscription packages are billed on a recurring monthly or yearly basis until cancelled.
• Cancellation: You can cancel your subscription at any time through the Settings panel. Your Pro benefits remain active until the end of the current billing cycle.
• Refunds: Payments are generally non-refundable due to immediate API costs incurred by the LLM backend on requests. If there is a billing issue or duplicate charge, please email our support team.
• Credits Ledger: Credit packages bought for Deep Case Analysis are consumed atomically (1 credit per successful analysis run) and do not expire.

6. Data Ownership & Intellectual Property

Your Uploads: You retain full ownership, copyright, and title to any files, case briefs, and draft data you upload or submit to the platform. We only process your files to generate your summaries and analyses, in compliance with our Privacy Policy.

Platform Material: All proprietary code, database schemas, semantic indexing matrices, scraping utilities, and UI assets are the exclusive intellectual property of the Company. You are granted a limited, non-exclusive, non-transferable, and revocable license to access our platform for your professional legal operations.

7. Disclaimer of Warranties & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING FITNESS FOR A PARTICULAR LEGAL ARGUMENT, ACCURACY OF OCR EXTRACTION, OR UNINTERRUPTED UPTIME.

In no event shall the Company, its directors, employees, or AI partners be liable for any direct, indirect, incidental, special, or consequential damages (including, without limitation, lost profits, malpractice penalties, court sanctions, or data breaches) arising out of your use or inability to use our platform, even if advised of the possibility of such damages. Our aggregate liability for all claims shall not exceed the amount paid by you to the Company in the three (3) months preceding the event.

8. Governing Law & Dispute Resolution

These Terms of Service and any dispute arising in connection with the KanoonHQ platform shall be governed by and construed in accordance with the laws of India. Any legal action, suit, or proceeding arising under these terms shall be subject to the exclusive jurisdiction of the competent courts located in **Bangalore, Karnataka, India**.
